Over the years, Empire Business Law has helped with the launch of many startup companies. We are sensitive to the needs of entrepreneurs. Our focus is to advise founders on typical matters such as raising capital safely, how to protect their intellectual property and to accelerate their growth sensibly.

Why Trademark Registration Matters More Than Ever

A registered trademark is more than a symbol of your business—it’s a powerful legal tool that gives you exclusive nationwide rights to your brand. Without a registered trademark, you're vulnerable to copycats, brand confusion, and missed opportunities. Our trademark registration service eliminates that risk by giving you full control over your intellectual property, backed by federal law.

Working with Empire Business Law ensures your application is filed correctly the first time, minimizing costly delays, office actions, or rejections. We don’t just submit forms—we guide you through every step, from initial clearance to long-term protection strategies.

What's Included in Our Trademark Registration Service?

When you hire a trademark registration lawyer from Empire Business Law, you get more than a filing—you get end-to-end legal protection tailored to your business goals. Our comprehensive service includes:

  • Comprehensive Trademark Search: We perform a detailed USPTO and common law search to ensure your mark is available and not likely to be rejected.
  • Legal Analysis & Strategy: You receive attorney-led guidance on trademark classes, strength of mark, and how to avoid refusals.
  • USPTO Application Filing: We handle every aspect of your TEAS Plus application, including drafting precise descriptions that avoid added fees.
  • Response to Non-Substantive Office Actions: We cover minor corrections or clarifications if requested by the USPTO.
  • Trademark Monitoring & Enforcement Guidance: After registration, we help you maintain and enforce your rights—because your trademark's power only grows over time.

How This Service Solves Real Business Pain Points

Registering a trademark isn’t just about paperwork—it’s about peace of mind. Many businesses delay trademark registration, only to find someone else has claimed their name or logo. Others try to file on their own, only to get rejected for using the wrong class or vague language. We solve these problems by:

  • Preventing costly mistakes and rejected filings
  • Saving you time with legal-led efficiency
  • Providing strategic brand protection
  • Giving you the legal tools to defend your mark if others infringe

When your brand is properly registered, you can confidently scale, attract investors, franchise, license, and grow—without fear of losing what makes you recognizable in the market.

Who Benefits Most from Trademark Registration?

Any business that relies on brand identity can benefit from federal trademark protection—but it’s especially critical for:

  • Startups building unique brand names or logos
  • E-commerce businesses operating across multiple states
  • Businesses expanding into new markets or product lines
  • Content creators, influencers, and digital brands
  • Anyone investing in marketing or packaging with a unique name or design

If your name, logo, or slogan matters to your success, protecting it with a trademark isn’t optional—it’s essential.

Long-Term Value Beyond Registration

Trademark registration with Empire Business Law isn’t a one-and-done service—it’s the foundation of brand longevity. Once registered, your trademark becomes a business asset that:

  • Increases your company’s valuation
  • Deters competitors from infringement
  • Enables future licensing or franchising
  • Allows you to sue for damages in federal court
  • Protects you from knockoffs in online marketplaces

Plus, we help you navigate trademark maintenance filings (like Section 8) and renewals, so your protection stays active year after year.

How Much Does It Cost to Register a Trademark in the US?

The base government fee for trademark registration is $350 per class of goods or services under the TEAS Plus application with the USPTO (effective January 18, 2025). Additional costs may apply depending on your filing choices:

  • $200 surcharge if you use a free-form text box to describe goods/services
  • $100 fee if your initial application is incomplete or requires significant correction
  • Ongoing costs, such as a $325 Declaration of Continued Use between years 5 and 6

While DIY filings seem cheaper upfront, errors often lead to rejections or added fees. Working with Empire Business Law ensures your application is filed right the first time—saving time, money, and frustration.

How Do I Register My Own Trademark?

You can begin the trademark registration process by:

  1. Conducting a comprehensive search on the USPTO and across common law databases to ensure your mark is available.
  2. Identifying the correct class of goods/services and gathering ownership details.
  3. Creating a USPTO account and submitting your application via the TEAS Plus portal.

However, the process is more complex than it appears. Vague wording, the wrong classification, or existing similar marks can trigger office actions or outright rejection. That’s why businesses turn to Empire Business Law. We streamline every step, so your brand is protected the smart way.

Do I Need an LLC to Get a Trademark?

No—you do not need an LLC to register a trademark. You can file as:

  • An individual
  • A partnership
  • Another type of business entity

That said, if you're operating a formal business or plan to scale, registering the trademark under your LLC can provide clearer asset ownership and transferability. At Empire Business Law, we help clients file under the proper entity—and even assist with LLC formation when needed. You can start as an individual and assign the trademark to your LLC later if your business structure evolves.

Frequently Asked Questions About Trademark Registration

  • How long does the trademark registration process take?

The USPTO trademark registration process typically takes 8 to 12 months, depending on whether the application faces objections or oppositions. At Empire Business Law, we ensure everything is filed correctly to minimize delays and improve your chance of fast approval.

  • Can I register a trademark for a logo and a name at the same time?

Yes, but each trademark (word mark vs. design/logo) must be filed separately and may incur separate fees. We often recommend starting with the word mark for broader protection, then filing the logo if it’s central to your branding.

  • What happens if someone is already using a similar name?

If another party has a confusingly similar trademark in the same class of goods or services, your application may be denied. That’s why we perform a deep clearance search before filing. If there's a conflict, we’ll advise on alternatives or strategy.

  • Is my trademark protected as soon as I apply?

You gain limited “common law” rights when you start using your mark, but federal protection begins after successful registration. Once filed, your application is listed in the USPTO database, which can deter others from adopting similar marks.

  • Will I need to maintain my trademark after registration?

Yes. The USPTO requires proof of continued use (usually between the 5th and 6th year after registration) and renewals at 10-year intervals. We help our clients stay on top of these deadlines so their protection never lapses.
